General Terms and Conditions for Concerts
We strive to provide you with the best possible service when purchasing tickets and visiting our performances. Please understand, however, that there is no right to specific tickets and a specific price or ticket category and that we can only offer tickets subject to the following general terms and conditions (GTC).
The prices as published on the website www.kunstkultur.com apply. The prices shown include the respective statutory VAT.
Conclusion of the contract
All orders are binding and cannot be cancelled or changed. Since the services offered are considered leisure services within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG), the customer is not entitled to a special right of withdrawal in the case of a contract concluded at a distance or in the case of a contractual declaration stated at a distance (Fernabsatz).
Exclusion of a right of return and exchange
The return or exchange of tickets that have already been paid is not possible. No refund can be made for tickets that have not been used, or only partially used, or for tickets that have been lost in any way.
Cancellation of an event
Tickets can only be returned where they were purchased! If copies have been made and are in circulation, only the ticket presented or submitted first entitles the holder to a refund of the purchase price.
In the event of cancellation, postponement or change of program, no expenses (such as hotel, travel expenses, etc.) will be reimbursed.
Changes to the cast, program and/or schedule as well as changes to the start times are expressly reserved and shall not be deemed a reason for the return and/or exchange of tickets. If the event has lasted until the break or 45 minutes after the start, no refund will be made. For organizational reasons, it is unfortunately not possible to refund the ticket price on site.
Copyrights and other property rights, portrait protection
For copyright reasons audio and video recordings of events are only permitted with the consent of the artists. By purchasing a ticket, you declare your consent that Kunst & Kultur - ohne Grenzen may take photographs and video recordings during the events and may reproduce and publish them online and offline without limitations in time or space. By giving your consent you expressly waive any entitlement to remuneration.
Admission only with a valid ticket
The printout of the ticket must be brought to the event. It is required for admission. The code of your ticket is only valid for one admission. If copies have been made and are in circulation, only the ticket presented first is valid for admission. Each valid ticket entitles one person to attend the performance. The valid ticket must always be presented to the staff of Kunst & Kultur - ohne Grenzen upon request.
By ordering and using services of Kunst & Kultur – ohne Grenzen, in particular by purchasing tickets - the customer expressly agrees to the GTC. The customer acknowledges that the data provided electronically by him will be processed electronically by Kunst & Kultur - ohne Grenzen for the purpose of fulfilling the contract. He also agrees to the use of his data for advertising purposes within the statutory provisions and restrictions of the DSGVO. A passing on of the data to third parties is excluded. The customer is made aware that this consent may be revoked at any time.
Scope of application, place of jurisdiction, law
Place of jurisdiction is Vienna, Austria. Austrian law excluding its conflict of laws provisions and the United Nations Convention on Contracts for the International Sale of Goods (CISG) shall apply.
Should individual provisions of these GTC contradict mandatory statutory provisions (such as the provisions of the KSchG), the remaining provisions of these GTC shall nevertheless retain their validity. We reserve the right to change our general terms and conditions at any time.
In case of discrepancies between these GTC and the German version, available under this link, the German version shall prevail.
